Last year, I was visiting a friend in Falls Church City and I went out to his car to get a CD that was in his stereo. I had to use his keys to get the CD out of the stereo. The FCPD was on the street looking in cars (for what reason I do not know). They came up as I was getting the CD (the car was parked in front of his place) and did a field sobriety test on me (we had been drinking a bottle of wine after dinner). They arrested me for "drunk in public" and took me to Arlington. The Arlington PD told me this would not be considered an arrest, just a fine.
I went to court and pled not guilty, but the officer told the judge I could have been operating the vehicle because the keys were in the ignition (to get the CD) and was found guilty (it was not my car and I don't have a drivers license). I paid the fine, but see it is a class 4 misdemeanor. The court cashier said it was just a fine as well. I am up for a job and going through the background check (they told me it could take a few weeks for VA counties). Would like thoughts/opinions about where it would show up (I live in Fairfax County) from law enforcement or legal people.
